These are the general terms and conditions of transactions with the company LASKI DESPOINA, based at 23 Dimokratias Street, 50100 Kozani (hereinafter referred to as the “Supplier”) which are concluded between the supplier and the customer referred to in article 1, paragraph 2 (hereinafter referred to as the “customer”) in the context of orders via the electronic platform artedigusto.gr.
Article 1. Scope, definitions
(1) With regard to the commercial relationship between the supplier and the customer, the following general terms and conditions of transactions, as in force at the time of the order, apply exclusively. No other terms and conditions of the customer are recognized, unless the supplier expressly agrees to their acceptance in writing.
(2) The customer is a consumer if the purpose of the ordered deliveries does not fall within his commercial or professional activity as a freelancer. On the contrary, an entrepreneur is defined as any natural or legal person who, at the time of concluding the contract, is exercising his commercial or professional activities.
Article 2. Conclusion of a contract
(1) The customer can select products from the supplier’s range of goods and add them to the so-called shopping cart via the “add to cart” button. With the “send order” button, he gives a binding purchase order for the products in the shopping cart. Before sending the order, the customer can modify and view the data at any time. However, the order can only be given and transferred if the customer accepts these terms and conditions by clicking on the button “I have read and agree to the terms and conditions of the ARTE DI GUSTO (artedigusto.gr) website” and in this way accepts the terms and conditions with his order.
(2) The supplier then sends the customer an automatic confirmation of receipt via email, which once again refers to the customer’s order and which the customer can print via the “print” function. The confirmation of receipt documents that the customer’s order has been received by the supplier and is considered acceptance of the order.
Article 3. Delivery, product availability
(1) Σε περίπτωση που κάποιο προϊόν που αναφέρεται στην παραγγελία του πελάτη δεν είναι προσωρινά διαθέσιμο, ο προμηθευτής το γνωστοποιεί στον πελάτη άμεσα με την επιβεβαίωση παραγγελίας. Σε περίπτωση καθυστέρησης της παράδοσης πέραν των δέκα εργάσιμων ημερών από την ημερομηνία αποστολής ο πελάτης δικαιούται να υπαναχωρήσει από τη σύμβαση. Σε αυτήν την περίπτωση, έχει και ο προμηθευτής την υποχρέωση να λύσει τη σύμβαση, οπότε και επιστρέφονται άμεσα πληρωμές που ενδέχεται να έχει πραγματοποιήσει ο πελάτης.
(2) For all products offered in the online store, a delivery time of five (5) to seven (7) business days applies, except during the holiday period, when there is a clear announcement.
(3) The online store artedigusto.gr exclusively issues retail sales receipts.
Article 4. Prices and shipping costs
(1) All prices listed on the supplier’s website include packaging costs and VAT.
(2) The corresponding shipping costs are stated on the customer’s order form and are posted on the “Payment Methods” page.
(3) The products are shipped via the courier company. The delivery address is accepted if the geographical area of destination is in the list served by the company.
(4) If your package is damaged upon delivery, you must report it to the courier service. The recipient must report the damage in writing to the relevant branch of the courier company, within the legally specified deadline of one week after receipt of the package. When reporting, the package must be presented exactly as received, with all its packaging materials. Article 5. Payment methods
The website artedigusto.gr supports the following payment methods:
- In cash, paying the price of your order to the courier company.
- By credit or debit card without any additional charge. Visa, Mastercard and Maestro cards are supported. Payments by card are supported by the information system of the National Bank of Greece, offering absolute transaction security.
- By bank deposit to the bank accounts as listed on the relevant “Payment Methods” page.
Article 6. Data protection
To prevent unauthorized access to your data by third parties, we use the latest encryption techniques, the Secure Socket Layer (SSL) protocol, a standard Internet protocol that ensures secure data exchange. In this way, all order-related data is transmitted exclusively in encrypted form.
Article 7. Liability for actual defects, warranty
(1) The supplier is liable for actual defects in the shipped products in accordance with the laws and provisions applicable in the specific case.
Article 8. Order return – cancellation – termination policy
As defined on the corresponding “Refund and Product Policy” page.
Article 9. Instructions regarding the processing of personal data
“The processing of personal data is carried out in accordance with the provisions of the General Data Protection Regulation”
(GDPR 2016/679), any specific national and European legislation for certain sectors, the currently applicable Greek legislation on the protection of personal data, as well as on the protection of personal data and privacy in the field of electronic communications (Law 347/2006, as applicable) and the decisions of the Personal Data Protection Authority (PDPA)”
(1) The supplier receives customer data in the context of the execution of his orders. During this process, the provisions provided by law are fully complied with. The supplier collects, processes or uses customer data and data relating to the use of the website artedigusto.gr by the customer without his approval, as long as this is required for the execution of his orders only.
(2) The supplier does not use customer data for advertising purposes or for market research and polls without their approval.
(3) The customer has the ability to recall the data they have saved in their profile at any time using the button
“Account Details”, to modify or delete them. Otherwise, regarding the customer’s consents and other information regarding the collection, processing and use of his data, you can refer to the page “Personal Data & Security”.
Article 10. Final provisions
(1) Contracts between supplier and customer are governed by Greek law and the Courts of Thessaloniki are competent for any dispute.
(2) The contract remains binding as to the remainder of it even if individual points thereof do not have legal force.
